Fadiel Adams, the leader of the National Coloured Congress (NCC) and a Member of Parliament, is facing a tough battle in his bail application, as prosecutors use his social media posts to challenge his bid for freedom. The Pinetown Magistrate’s Court was presented with evidence of Adams’ history of disrespecting the rule of law, including the South African Police Service and the criminal justice system.

According to the affidavit by investigating officer and Political Killings Task Team (PKTT) member Sergeant Sandile Mavuka, Adams has made numerous public comments that may be viewed as defamation of character against the PKTT and people he perceives are linked to the PKTT. The affidavit also highlights Adams’ previous run-ins with the law, including a 2023 case where an order was issued against him by an Equality Court for making utterances against the City of Cape Town municipal manager.

Adams’ Social Media Posts Under Scrutiny

The court was shown video clips posted on social media, which date back to 2023, and feature Adams making reckless statements without facts. In one post, Adams said: ‘Lock me up. I won’t apologise to that p***’. He also said: ‘The Equality Court finds that I’ve discriminated against the city manager who’s discriminated against us. F**k the court’. These posts led to a criminal charge being opened against him, which was later withdrawn after mediation.

Previous Cases Against Adams

Adams has a history of being arrested and charged with crimen injuria. In one case, he was ordered by the court to unconditionally issue a public apology to the complainant and undertake a programme on racial sensitivity training at his own expense. Another case was declined for prosecution and referred to a civil court. The National Prosecuting Authority (NPA) has intervened in some of these cases, highlighting the seriousness of the charges against Adams.

As the bail application continues, the court will have to consider the evidence presented and decide whether Adams poses a risk to the public or the criminal justice system. The case has sparked interest in the South African justice system and the role of social media in shaping public opinion.
