A Muslim community in Cape Town is reeling after the arrest of former Waterloo Road Mosque imam, Mogamat Farouk Rylands, on charges of contempt of court. Rylands, who served as the imam for around 20 years, was arrested for allegedly breaching a court interdict granted in December 2023. The interdict, which was challenged in the Constitutional Court but dismissed, ordered Rylands to vacate his post as imam and not obstruct or prevent the Ashrafiah Trust from appointing a new imam.

According to court documents, Rylands was sentenced to six months imprisonment, wholly suspended for a period of 12 months, on condition that he comply with the order within seven days. However, legal expert Igshaan Higgins, Director of DKVG Attorneys, believes that Rylands did not violate the court order, stating that reciting a prayer after salaah does not constitute leading a prayer. Higgins expressed disappointment with how the matter played out, emphasizing that the court should have consulted an Islamic scholar to review the issue.

Background to the Case

The controversy surrounding Rylands began in 2023 when the Ashrafiah Trust took him to court for refusing to vacate his position as imam. The Trust, which oversees the mosque, had attempted to remove Rylands, but he resisted, leading to a protracted legal battle. The Labour Court ultimately granted an interdict against Rylands, which he challenged in the Constitutional Court. The Constitutional Court dismissed the challenge, upholding the interdict.

Community Reaction

The Kenwyn Islamic Society (KIS) has expressed disappointment and concern over Rylands’ arrest, stating that an urgent ex parte application is being prepared to bring Rylands before the Labour Court for a factual inquiry. The application will also seek an order for his release from Pollsmoor Prison. The KIS has planned a community meeting to discuss a plan of action and has arranged to visit Rylands at Pollsmoor to ensure his well-being.
