A shocking case of racial violence has led to three farmers being sentenced to life imprisonment for the premeditated murder of a farm resident in South Africa. Jaco Wessels Kemp, 36, Louise Coetzee, 29, and Gert Frederik van der Westhuizen, 38, were convicted and sentenced for the killing of Dumisani Phakathi in a case that has sparked outrage across the country.
According to the National Prosecuting Authority (NPA), the court heard that on September 16, 2023, the three were socialising at a braai at a chicken farm in Mamokgalieskraal when they noticed Phakathi walking past the farm gate. The group approached Phakathi, assaulted him, and dragged him into a storage facility on the farm, where the assault continued until he succumbed to his injuries.
Racial Motivation
The court found that the murder was racially motivated, with the judge concluding that the only reasonable inference was that the killing was driven by racial hatred. The prosecution argued that the murder was senseless and carried out in a cruel and inhumane manner, with the men placing the victim’s body in rubbish bags in an apparent attempt to dispose of it at a dumping site.
The South African Police Service (SAPS) played a crucial role in apprehending the suspects, with officers stopping a bakkie driven by Kemp and Coetzee on the R511 near Brits and discovering Phakathi’s body in the back. Van der Westhuizen handed himself over to police the next day.

In addition to the life sentences, the court declared the trio unfit to possess firearms and ordered them to surrender all firearms, ammunition, licences, authorisations, and permits to the investigating officer. The defence had asked the court to deviate from the prescribed minimum sentence, citing the time already spent in custody and their responsibilities as parents, but the prosecution opposed the request, arguing that the murder was too heinous to warrant leniency.
