14 Cops Face Trial Delays in Regan Naidoo Murder Case

Regan Naidoo, a 32-year-old man, died from alleged torture in Chatsworth police custody in 2018. Fourteen police officers, including Pushpanthan Pillay, Malcolm Naicker, and Brian Naidoo, are facing trial for their alleged involvement in his kidnapping and murder. The trial has been delayed due to changes in legal representation, with some of the accused wishing to withdraw from their current advocate, Carl Van Der Merve.

Delays in the Trial

The trial was set to begin, but the changes in legal representation have caused a setback. Magistrate Maryn Mewalal expressed concern that the accused may be using delay tactics to avoid the trial. Van Der Merve stated that he was only informed of the changes on the morning of the court appearance and was unable to take proper instructions from his clients.

The Independent Police Investigative Directorate (Ipid) had investigated the case and arrested the 14 police officers in 2021. The accused include Trevor Chetty, Andries Botes, Erik Karsen, Muhammed Raoof, Preshan Lutchman, Cedric Pillay, Xolani Sosibo, Kubendran Kisten, Rajan Sanders, Devendra Chetty, and Ugeshan Govender.

Concerns Over Delay Tactics

Mewalal questioned the motives behind the changes in legal representation, stating that it may be a ploy to delay the trial. She expressed concern that the accused did not inform their defense team of any issues prior to the court appearance. The magistrate also noted that the State is ready to proceed with the trial, but the defense’s actions may cause further delays.

According to the Department of Justice and Constitutional Development, the trial will resume at a later date, pending the resolution of the legal representation issues.
